Crypto lawyer John Deaton believes that the appeal from the SEC in the Ripple case is not a significant setback for Ripple Labs. The recent courtroom victory ruling that XRP is not necessarily a security still stands until a decision is issued by the 2nd Circuit, which could take two years. Deaton also argues that even if the SEC challenges the ruling, it would be difficult for them to prove the existence of a common enterprise under the Howey Test.
